Terms of Service

1. Acceptance of Terms

By accessing or using the WePay platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into binding contracts, and are not prohibited by applicable law from using financial services.

3. Account Registration

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

WePay reserves the right to refuse registration, cancel accounts, or remove content at our sole discretion.

4. KYC and Identity Verification

As a regulated financial service provider, WePay is required to verify the identity of all users (Know Your Customer / KYC). You agree to submit valid government-issued identification and any other documents required to complete verification. Failure to complete KYC may result in limited access or account suspension.

5. Virtual Cards

Virtual cards issued through WePay are for authorized users only and must be used in accordance with the terms of the issuing card network (Visa or Mastercard). You agree not to use WePay virtual cards for:

  • Any illegal transactions or activities prohibited by law
  • Purchase of controlled substances or illegal goods/services
  • Money laundering, fraud, or other financial crimes
  • Transactions violating Visa or Mastercard network rules
  • Circumventing card limits or platform controls

6. Wallet and Funds

Your WePay wallet holds electronic money that is safeguarded in accordance with applicable regulations. WePay is not a bank, and wallet balances are not bank deposits. Wallet funds are not covered by NDIC or FSCS deposit protection schemes. You may withdraw your wallet balance at any time subject to applicable limits and verification requirements.

7. Fees and Charges

Fees applicable to WePay services are disclosed on our Pricing page and within the platform at the time of each transaction. WePay reserves the right to change fees with 30 days' notice. Continued use of the Service after notice constitutes acceptance of the new fees.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated scripts, bots, or scrapers on the platform
  • Resell or commercially exploit WePay services without written authorization
  • Interfere with or disrupt the integrity or performance of the Service
  • Engage in chargeback fraud or abuse of dispute mechanisms

9. Intellectual Property

The Service and its original content, features, and functionality are owned by WePay and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

11. Dispute Resolution

For unauthorized transactions or billing disputes, contact our support team within 60 days of the transaction date. WePay will investigate disputes and, if resolved in your favor, credit your account accordingly. Disputes must be submitted in good faith with supporting documentation.

12. Limitation of Liability

To the maximum extent permitted by applicable law, WePay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

13. Termination

WePay may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request account closure at any time by contacting support, subject to withdrawal of any remaining wallet balance.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
